Introduction and Acceptance of Terms

Welcome to Flux.art, an AI Image & Video Creation Platform. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Flux.art provides users with AI-powered image and video generation services. You can create visual content through text descriptions or reference images. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

  1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

  1. Your Content Ownership: You retain ownership of all content you create (including input prompts, generated images and videos). You are free to use, modify, and commercialize your work.

  2. Platform Rights: The Flux.art platform, AI models, interface, and underlying technology are protected under copyright law and owned by flux.art.

  3. Public Content License: When you choose to publicly share your work, you grant Flux.art a non-exclusive license to display, distribute, and promote your content for platform operation and marketing purposes.

  4. AI Model Training: Unless you explicitly opt out, your generated content may be used to improve our AI model quality.

Acceptable Use Policy (AUP)

Flux.art provides AI image and video generation features (including text-to-image, image-to-image, text-to-video, image-to-video, photo restoration, and related generation tools). This Acceptable Use Policy applies to all prompts, uploads, generated outputs, and public or private content on the Platform. You must comply with this AUP in addition to the rest of these Terms.

Content Standards & Prohibited Categories

The Platform prohibits generating, uploading, distributing, or storing content in the following six categories:

  1. Pornography / NSFW — Explicit sexual content, pornography, or other NSFW material.
  2. Violence / Gore — Graphic violence, gore, or content that glorifies severe physical harm.
  3. Hate Speech — Content that attacks, demeans, or incites hatred or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or similar protected characteristics.
  4. Child-Unsafe Content (CSAM) — Any sexual content involving minors (anyone 17 or under), including fictional or AI-generated depictions. Zero tolerance. We will remove such content, ban the account, and may report to authorities.
  5. Deepfakes / Impersonation — Non-consensual deepfakes, realistic impersonation of real people (especially for deception, fraud, defamation, or non-consensual intimate imagery), or content designed to mislead others about a person's identity or actions.
  6. Copyright / Trademark Infringement — Content that infringes copyrights, trademarks, publicity rights, or other intellectual property rights of third parties.

Absolutely prohibited (zero tolerance): child sexual abuse material (CSAM); content promoting terrorism, extremism, or mass violence; instructions for weapons of mass destruction; content inciting genocide or ethnic hatred; and non-consensual deepfake sexual content targeting real individuals.

Other prohibited conduct includes: generating or spreading harmful misinformation; bulk spam or deceptive commercial content; jailbreak prompts intended to bypass safety measures; abusing the service for large-scale automated attacks; interfering with service security or performance; bypassing the credit system; and unauthorized access to or reverse engineering of our AI models.

Platform Content Moderation

We operate a multi-layer moderation system:

  1. Automated review (real-time) — Prompts and generated outputs may be scanned by safety filters, including keyword/semantic detection on inputs and safety assessment on outputs. Anomalous usage patterns may be flagged.
  2. Human review — Auto-flagged and user-reported content may be reviewed by our trust & safety team.
  3. Periodic audits — We may sample content and improve classifiers over time.
  4. Severity-based enforcement — Critical violations (e.g., CSAM, terrorism) may result in immediate blocking, account ban, and reporting to authorities. Other violations may result in content removal, warnings, feature restrictions, temporary suspension, or permanent ban.

We may refuse, remove, or block generation requests that violate this AUP, and may retain limited logs needed for safety, abuse prevention, and legal compliance.

Reporting Violations

If you encounter content or behavior that violates this AUP (including hate speech, CSAM, deepfakes, or IP infringement), please report it promptly:

  • Email: support@flux.art (subject line recommended: AUP Report or Safety Report)
  • Include, where possible: the content URL or task ID, a short description of the violation, and relevant screenshots.

We treat reporter identity as confidential to the extent permitted by law. Malicious or knowingly false reports may result in enforcement action.

You may appeal an enforcement decision by emailing support@flux.art with subject AUP Appeal within 14 days of notice. Appeals are reviewed by a person who was not the sole original decision-maker where practicable.

Privacy and Data Collection

Flux.art collects the following types of data:

  • Account Information: Information you provide when creating an account
  • Creative Content: Your prompts, generated images and videos, uploaded reference images
  • Usage Details: Data related to your activity on our service
  • Device Information: Information about the device you use to access our service
  • Cookies: Data that helps us enhance your experience with our service
  • Payment and Credits Information: Data necessary to process payments

Credits and Payments

  • Flux.art uses a credit system. Generating images and videos consumes corresponding credits
  • New users receive 10 free credits upon registration for trial
  • Unused credits do not expire but will be forfeited upon account closure
  • Prices are subject to change with advance notice to users
  • You agree to pay all charges associated with your purchased credit packages

Refund Policy

  • We offer refunds within 7 days of purchase if you have not used any credits from your purchase
  • To request a refund, please contact us at support@flux.art
  • We will respond to all refund requests within 3 business days
  • Refunds will be processed using the original payment method
  • Partially used credit packages are not eligible for refunds
  • Refunds may be issued at our discretion for technical issues that prevent service use

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, flux.art shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless flux.art, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which flux.art operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
